Recently, the USCIS announced that in order for Haitian TPS-holders to maintain their TPS status, they must re-register. As a Miami immigration lawyer, this reminder is key. If you are a Haitian TPS holder, please pay attention to the deadlines below:

When  do I have to file for TPS?

The original 60-day re-registration period has been extended, and now runs from August 25, 2015 through October 26, 2015. This is your re-registration period. I would highly encourage you to register as soon as possible within the re-registration period. What happens if I have never been granted TPS?

If you have never been granted TPS, you may be eligible to file a late initial application. Again, you may want to speak with a Miami immigration lawyer to obtain more information.

Do I have to apply to extend my Employment Authorization Document (EAD)?

USCIS has automatically extended the validity of employment authorization documents issued under the last extension/designation of TPS Haiti for an additional 6 months, through July 22, 2016. If you have a TPS Haiti EAD with an original expiration date of January 22, 2016, you are covered by this automatic extension and may continue to work. If you have any questions about this, you may want to speak with a Miami immigration attorney.

What kinds of documentation do I have to show in order to work in the U.S.?

To continue to work, you may show the following documentation to your employer and government agencies:

Your employer may rely on the Federal Register notice as evidence of the continuing validity of your EAD. Again, if you have any questions in regard to this, you may want to speak with a Miami immigration lawyer.

The USCIS has approved my TPS re-registration application, and I have requested an EAD. What can I expect?

If USCIS approves your TPS re-registration application and you requested an EAD, you will be issued a new EAD bearing the expiration date of July 22, 2017.
